A recent China Law Blog article outlined why getting to market first with your new product isn’t great protection against copycats these days, especially if corners have been cut in the name of speed.
Some entrepreneurs believe that skipping IP protection and launching quickly will mean copycats can’t copy them quickly enough before they’ve built their brand and made plenty of sales and if there are IP infringement issues they can handle them later.

Copy Cats and clones are a huge problem. The most shocking is when you see Amazon copy a successful product. Amazon will always win and get priority with their adds. It’s a vicious cycle. You create a successful product which you invested in then you pay Amazon for their adds, then they make a knock off and knock you out of position by placing their own product in adds above yours. They make the product cheaper and they drive your margins down and kill your success. Then they shut you down with accusations of old inventory, stranded products and any other algorithms secret to lower your score and get rid of you. You take the risk, they jump in and put you out of business. We need protection from this. I’m not sure a patent is enough to stop the giant.
